These Terms of Service ("Terms") apply to your use of gardnclean.com (the "Website") and to purchases you make from us. The Website is operated by Clodi, LLC d/b/a Gard'nClean, a Florida limited liability company ("Gard'nClean," "we," "us," "our"). By using the Website or placing an order, you agree to these Terms. If you do not agree, please do not use the Website.

Our Privacy Policy, Shipping Policy, Return and Refund Policy and Purchase Options Cancellation Policyare part of these Terms.

1. Eligibility

You must be at least 18 years old to buy from us or create an account. We sell through the Website to customers in the United States only.

2. Our products and their labels

  • Follow the label. Every product must be stored, used and disposed of according to its product label and Safety Data Sheet. The product label is the legal document that governs use. Information on the Website, in our emails or from our team is for general guidance and does not replace or expand the label.
  • EPA-registered products. Gard'nClean Liquid (EPA Reg. No. 74986-5) and Gard'N 3000 (EPA Reg. No. 75757-2-105816) are registered pesticides. It is a violation of federal law to use them in a manner inconsistent with their labeling. Some label uses are not permitted in every state; check the label before use.
  • Products that are not EPA-registered. Gard'nClean Fast Release and Gard'nClean Extended Release are sold for air quality improvement and odor elimination, and LineGard for the removal and inhibition of scale and buildup in non-potable water systems. They are not EPA-registered, not labeled for sale as pesticides, and must not be used or represented as disinfectants, sanitizers or other pesticides.
  • Professional use. Our products are intended for professional and commercial use by people who have read and will follow the label, including its directions on protective equipment.
  • Your responsibility. You are responsible for choosing the right product for your application, for using it as labeled, and for complying with all federal, state and local laws that apply to your use, storage, transport and disposal.

3. Prices, orders and availability

  • Prices are in US dollars and are shown at checkout, along with any taxes and shipping charges. Some products, such as Gard'N 3000 and LineGard in drums and totes, are sold by quote only.
  • Your order is an offer to buy. We accept it when we ship it or confirm it in writing. We may refuse, limit or cancel any order, including for suspected fraud, errors in price or description, product availability, or shipping or regulatory restrictions. If we cancel an order you have paid for, we will refund the amount you paid.
  • We try to describe and price products accurately. If we find an error, we will correct it and give you the option to continue with the corrected order or cancel it.
  • We may change prices, products and offers at any time without notice. Changes do not affect orders we have already accepted.

4. Bulk quotes

Quotes requested through our bulk quote page are estimates based on the information you give us. A quote becomes binding only when we confirm the order in writing, and it is valid for the period stated on the quote. Freight terms, delivery requirements and any advance payment will be set out in the quote.

5. Subscribe and Save

Subscribe and Save lets you receive selected products automatically. By subscribing, you agree that:

  • your order renews automatically every 30 days from the date of your original order, and your payment method is charged for each renewal at the subscription price (5% off the regular price), plus any applicable tax and shipping, until you cancel;
  • renewal orders ship under our Shipping Policy, including free shipping on orders of $500 or more;
  • there is no minimum number of orders, and you can skip, change or cancel at any time in your customer account (subscription portal) or by contacting us at hello@gardnclean.com or 888-369-1975, at least 2 business days before your renewal date;
  • a renewal that has already been charged can be canceled and refunded if it has not shipped; once shipped, our Return and Refund Policy applies.

We may change or end Subscribe and Save. If we do, we will email you before the change affects your subscription. See our Purchase Options Cancellation Policy for details.

6. Payment

Payments are processed by our payment providers, including Shopify Payments, Shop Pay and PayPal. We do not receive or store full payment card numbers. You confirm that you are authorized to use the payment method you provide and that your billing information is accurate.

7. Shipping, hazardous materials, returns and cancellations

Shipping, delivery, returns, refunds, order changes and cancellations are covered by our Shipping Policyand Return and Refund Policy. Some products, such as Gard'nClean Liquid GC-30, ship as hazardous materials and are subject to carrier rules on how, when and where they can be shipped.

8. Accounts

If you create an account, keep your login details confidential and make sure your information is accurate. You are responsible for activity on your account. We may suspend or close an account at our discretion, and you can close yours by contacting us.

9. Reviews and other content you submit

When you submit a review, comment, photo or other content, you grant Gard'nClean a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, publish and display it in connection with our business. You confirm that your content is accurate, is your own, and does not violate anyone's rights. Do not post content that is unlawful, harassing, abusive, discriminatory, sexually explicit, violent, misleading, infringing, spam or advertising, or that shares anyone's personal information without consent. Reviews must describe your own experience and must not make claims about a product that go beyond its label. We may remove any content at our discretion.

10. Affiliate program

Our affiliate program is run through UpPromote and is governed by its own program terms, which you accept when you join. Affiliates must describe our products only as their labels allow and must follow the program's advertising rules.

11. Prohibited uses

You agree not to:

  • use the Website for any unlawful purpose or in violation of these Terms;
  • impersonate Gard'nClean or anyone else, or misrepresent your affiliation with anyone;
  • send spam or unsolicited advertising through the Website;
  • use bots, scrapers or other automated means to access, copy or monitor the Website without our written permission;
  • attempt to gain unauthorized access to, damage, overload or disrupt the Website or its systems, including by introducing viruses or denial-of-service attacks;
  • resell our products with claims, labeling or packaging that differ from the product label.

12. Intellectual property

The Website and its content, including text, graphics, logos, images, product information and software, are owned by Gard'nClean or its licensors and are protected by copyright, trademark and other laws. Gard'nClean, Gard'N 3000 and LineGard are trademarks of Clodi, LLC. You may not copy, modify, distribute or use our content or trademarks without our written permission, except to view the Website and to buy from us.

Copyright complaints

If you believe content on the Website infringes your copyright, send a notice to hello@gardnclean.com or to our mailing address below, including:

  • your physical or electronic signature, or that of the person authorized to act for the owner;
  • a description of the work you say is infringed and where the infringing material appears on the Website;
  • your name, address, telephone number and email;
  • a statement that you believe in good faith the use is not authorized by the owner, its agent or the law; and
  • a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act for the owner.

13. Third-party links and services

The Website links to other websites and uses third-party services, such as payment, review and help-center providers. We are not responsible for their content, policies or practices, and your use of them is at your own risk and subject to their terms.

14. Disclaimer of warranties

Each product is covered only by the warranty and conditions of sale on its product label, if any. EXCEPT FOR THAT LABEL WARRANTY AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," AND WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not warrant that the Website will be uninterrupted, error-free or free of harmful components, or that results from using a product will meet your expectations; results depend on conditions and on use according to the label.

15. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GARD'NCLEAN AND ITS OWNERS, EMPLOYEES, SUPPLIERS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, CROPS, PRODUCTS OR DATA, ARISING FROM YOUR USE OF THE WEBSITE OR ANY PRODUCT, INCLUDING ANY USE INCONSISTENT WITH THE PRODUCT LABEL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO A PRODUCT OR ORDER IS LIMITED TO THE AMOUNT YOU PAID FOR THAT PRODUCT OR ORDER. Some states do not allow certain limitations, so some of these may not apply to you.

16. Indemnification

You agree to defend, indemnify and hold harmless Gard'nClean and its owners, employees and agents from any claims, losses, damages and expenses, including reasonable attorneys' fees, arising from your use of a product in a manner inconsistent with its label, your breach of these Terms, or your violation of any law or third-party right.

17. Governing law, disputes and venue

These Terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms, the Website or your purchases will be resolved in the state or federal courts located in Hillsborough County (Tampa), Florida, and you consent to their jurisdiction. YOU AND GARD'NCLEAN AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.

18. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the policies they reference, are the entire agreement between you and us about the Website and your purchases. You may not transfer your rights under these Terms; we may transfer ours.

19. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted here with a new "Last updated" date and applies to orders placed and use of the Website after it is posted.
